Description
The total area of the plot is: 572 m², and the structure is a residential property. According to the tax and value certificate, on the seized parcel number 116392, there are two separate residential properties located, held in undivided common ownership. Single-story, brick masonry, slate roofing, with all public utilities, in need of renovation. No usage agreement is available regarding the undivided common ownership, but with regard to Section 141 of the Vht., the 5/10 debtor's ownership share is to be auctioned as habitable. In connection with the property indicated in this notice, I draw attention to the fact that the property auction procedure must be conducted, pursuant to the main rule applicable under Section 141 (2) of Act LIII of 1994 (hereinafter: Vht.), by auctioning the property in a habitable condition. Section 141 (3) of the Vht. precisely defines when the property to be sold at auction may be sold as occupied. In the present procedure, the fractional ownership share of the property constituting the debtor's ownership interest put up for auction has been advertised as habitable, since the occupied conditions defined in the Vht. are not met; nevertheless, in the event of a successful property auction procedure, in accordance with the general rules of the Vht., the bailiff shall ensure access to the property - in the nature of possession transfer, but without vacating the property - for the successful bidder upon a properly submitted request.
