Description
500 m2 of designated residential building and yard is being auctioned in the debtor's 8/16 ownership share. Based on the tax and value certificate, the property contains a residential building of approximately 80 m2 floor area, with brick masonry, tile roofing, in need of renovation. Utilities: water, gas, electricity, and sewerage. The yard contains a garage and an outbuilding. With regard to the property indicated in this notice, I draw attention to the fact that, pursuant to the general rule applicable under Section 141 (2) of Act LIII of 1994 (hereinafter: Vht.) on the conduct of the property auction procedure, the property must be auctioned in a condition suitable for occupancy. Section 141 (3) of the Vht. precisely defines when the property to be sold at auction may be sold as occupied. In the present procedure, the fractional ownership share of the property put up for auction has been advertised as occupiable, since the occupied conditions set out in the Vht. are not met; nevertheless, the handover procedure cannot be conducted within the framework of the present enforcement proceedings.
